Johnson & Johnson talc settlement reaches $5.5 billion | AI-Generated Image

Johnson & Johnson said in an announcement that the $5.5 billion settlement will resolve approximately 76,000 claims consolidated in federal court in New Jersey together with related state court cases. The agreement covers 99.75 percent of the outstanding talc litigation according to multiple reports including one from Reuters. Lead plaintiff firms must participate and at least 95 percent of claimants must agree for the deal to become final a process that may take several months.

Payments under the settlement are scheduled for $3 billion in 2027 with the remainder due in 2028 though the total value is uncapped and could rise depending on participation levels. A Wall Street Journal assessment found the commitment stands at $5.5 billion for claim payments while noting the deal excludes any future claims that might emerge. Johnson & Johnson vice president Erik Haas stated the claims were meritless but the company chose to settle to achieve closure.

The litigation has persisted for more than a decade with Johnson & Johnson previously attempting to resolve cases through bankruptcy proceedings by subsidiaries that federal courts dismissed on appeal according to Reuters coverage. Mixed trial results included multi-billion dollar verdicts in some states although many awards were reduced or overturned. Data compiled by law firms tracking the cases place the total number of talc lawsuits filed against the company at more than 90,000 as of July 2026.

Plaintiffs’ law firms confirmed the agreement describing it as a positive resolution following years of court battles. The settlement follows earlier proposals that included an $8 billion offer tied to bankruptcy restructuring which did not proceed. Court records show the multidistrict litigation in New Jersey had swelled to more than 68,000 pending cases before this accord.

Johnson & Johnson maintained in its statement that the resolution involves no admission of liability and will allow the company to focus on its primary healthcare operations. The firm has secured several favorable rulings in recent months including disqualification of certain expert witnesses and a federal judge’s skepticism regarding causation evidence. Earlier verdicts had at times reached $4.7 billion in a Missouri case before reductions on appeal.

The agreement arrives as Johnson & Johnson faces no further liability for these specific claims under the terms outlined in the announcement. Payments are expected to be distributed to participating claimants once final approval is secured. Reuters reported that the deal represents one of the largest resolutions in product liability history for the sector.
